Important Notice
I understand and agree that American Compliance Authority (ACA) is not a law firm and is not a substitute for an attorney or licensed professional. ACA provides administrative, compliance, and filing support services and does not offer legal, financial, or tax advice.
I acknowledge that I am representing myself in all regulatory, licensing, trademark, and compliance matters. No attorney-client relationship, fiduciary duty, or legal privilege is created between me and ACA.
If, prior to purchase, I believe ACA has provided legal advice or recommendations regarding my rights, remedies, or legal strategy, I will not proceed. Any such purchase will be considered void.
I understand that ACA reviews submissions for completeness, formatting, and consistency only. I am solely responsible for reviewing and approving all final documents before submission.
I agree that disputes will be resolved through binding individual arbitration, and I waive the right to jury trials or class actions as outlined in these Terms.
1. Accuracy of Information
I confirm that all information provided to ACA is accurate, complete, and up to date.
I understand that ACA relies entirely on the information I provide and is not responsible for errors resulting from inaccurate or incomplete submissions.
2. Electronic Consent & Authorization
I authorize ACA to prepare, submit, and process applications, filings, and documentation on my behalf where applicable.
I consent to the use of electronic records, communications, and signatures.
I understand I may withdraw consent prior to submission, but doing so may delay or cancel services.
3. Scope of Services
ACA provides administrative and compliance support services, including:
Business licensing and permits
Regulatory compliance support
Trademark-related services
Government filings and application preparation
ACA does not guarantee approvals, outcomes, or regulatory decisions.
4. No Legal or Financial Advice
ACA does not provide legal, tax, or financial advice.
All services are administrative in nature. I understand that I may consult a licensed professional if legal or financial guidance is required.
5. Limitation of Liability
To the maximum extent permitted by law:
ACA shall not be liable for indirect, incidental, special, or consequential damages
ACA is not responsible for delays, rejections, or decisions made by government agencies
ACA is not liable for losses resulting from incorrect information provided by the client
If liability is established, it will be limited to the total amount paid for the specific service.
6. Third-Party Services
I understand that ACA may work with government agencies or third-party providers.
ACA is not responsible for the actions, delays, or decisions of any third party.
7. Fees & Payments
All service fees must be paid before work begins
Government fees are separate and non-refundable
Pricing is subject to change without notice
Failure to complete payment may delay or cancel services.
8. Refund & Cancellation Policy
Due to the nature of compliance and filing services:
Services are non-refundable once work has begun
Completed or submitted filings are non-refundable
Government fees are non-refundable under all circumstances
Refund requests, if applicable, are subject to review at ACA’s discretion.
9. Abandoned Orders
Orders that remain incomplete due to lack of client response for 90 days may be considered abandoned and non-refundable unless ACA is at fault.
10. Service Timelines
I understand that:
Processing times vary based on government agencies
Delays may occur outside ACA’s control
ACA does not guarantee approval or timelines
11. Intellectual Property
All website content, materials, systems, and branding are the property of American Compliance Authority and may not be copied, reproduced, or distributed without permission.
12. Submitted Materials
Any documents, files, or materials submitted to ACA may be retained for processing purposes and securely stored or destroyed in accordance with internal policies.
13. Authority to Submit Applications
By purchasing services, I authorize ACA to prepare and submit applications on my behalf.
If I fail to respond to requests for information within a reasonable timeframe, ACA may delay or suspend services.
14. Compliance & Filing Disclaimer
ACA assists with preparation and submission only.
Final approval, rejection, or regulatory decisions are solely determined by the relevant government authority.
15. Monitoring & Ongoing Services
For services such as compliance monitoring or trademark monitoring:
ACA provides tracking and reporting support
ACA does not guarantee enforcement or legal protection outcomes
16. Internet Access & Communication
I am responsible for maintaining internet access and communication channels.
ACA is not responsible for delays caused by communication failures or technical issues.
17. Force Majeure
ACA is not liable for delays or failure to perform due to events beyond reasonable control, including:
Natural disasters
Government actions
System failures
Network disruptions
18. Right to Refuse Service
ACA reserves the right to refuse or terminate services at its discretion, including in cases of:
Misuse of services
Fraudulent activity
Violation of these Terms
19. Dispute Resolution & Arbitration
All disputes shall be resolved through binding arbitration on an individual basis.
No class actions or collective claims are permitted
Arbitration replaces court litigation except where prohibited by law
20. Governing Law
These Terms shall be governed by and interpreted under the laws of the United States.
21. Changes to Terms
ACA reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
